1. Kallas Proprietary Rights
Kallas retains exclusive ownership over all intellectual property associated with our 3D printing materials and filaments. This includes, but is not limited to:
- Formulations and chemical compositions of our filaments
- Manufacturing techniques, proprietary processes, and machinery
- Trademarks, branding, and associated marketing content
- Technical documents, guides, manuals, and instructional materials
These intellectual property rights are protected by copyright, trademark, patent, and trade secret laws across multiple jurisdictions, including Indian and international law. Any use of our materials is subject to the restrictions outlined in this policy.
1.1 License for Use of Kallas Products
Purchasing Kallas 3D printing materials grants you a limited, non-transferable, non-exclusive license to use the materials for personal or commercial 3D printing projects under the following conditions:
- Use is restricted to lawful activities, including prototyping, end-use production, and personal projects
- You may not reverse-engineer, modify, or reproduce the materials or filaments for resale or redistribution
- Ownership of the filaments or materials remains with Kallas, and any rights associated with the materials are not transferred upon purchase
2. Permitted Uses
2.1 Acceptable Applications
Kallas 3D printing materials are designed to support a wide range of applications across various industries. Permitted uses include:
- Prototyping and Model Making: Using Kallas materials to create prototypes, mockups, or concept models for product development
- Consumer Products: Manufacturing small batches of non-branded consumer products, including custom designs
- Functional Parts: Producing industrial-grade parts, tools, or components for machinery, automotive, or aerospace applications
- Educational and Research Use: Employing Kallas materials for student projects, research experiments, or scientific simulations
- Service Bureaus: Offering 3D printing services using Kallas filaments, provided that all designs used are properly licensed or owned
You are permitted to print from original designs that you own or have secured rights for, including those purchased or licensed from third-party designers.
2.2 Authorized Licensing
In cases where you are using third-party designs, it is your responsibility to ensure proper licensing for commercial use. Kallas supports customers who have obtained legal rights to use, modify, or sell printed objects derived from external designs.
3. Prohibited Uses and Restrictions
3.1 Infringement of Intellectual Property Rights
Under this policy, any use of Kallas 3D printing materials for infringing upon another party’s intellectual property rights is strictly prohibited. This includes:
- Unauthorized Replication: Using Kallas materials to reproduce copyrighted designs, logos, or branded products without permission from the copyright holder.
- Commercial Exploitation: Selling or distributing counterfeit goods or replicas of protected content without authorization from the IP owner.
- Reverse Engineering: Attempts to reverse-engineer Kallas filaments or materials to create competing products or to gain unauthorized access to proprietary formulations or trade secrets.
3.2 Copyright Violations in Printed Products
If you are printing third-party models, be sure that:
- The models are legally available for commercial or personal use
- You hold the appropriate licenses or permission to reproduce or sell those designs
- Kallas disclaims any responsibility for the legality of your printed products or designs
Unauthorized use of protected trademarks (e.g., brand logos, famous characters) on products manufactured with Kallas materials may result in legal action and penalties.
4. Customer’s Legal Responsibility
4.1 Verification of Design Rights
As a customer of Kallas, you are responsible for ensuring that the 3D models, designs, or files you use in conjunction with our materials do not infringe on the rights of others. This includes:
- Verifying that designs or files are free from copyright or trademark restrictions, or that proper licenses have been secured
- Not using pirated or unlicensed files for printing or distribution
- Taking the necessary steps to confirm that 3D models comply with IP laws for commercial distribution
4.2 Liability Disclaimer
Kallas does not assume any responsibility for the legality of designs or files used by customers. If you are using Kallas materials to print designs obtained from third parties, you must assume responsibility for ensuring that these designs are legally authorized.
Failure to comply with intellectual property laws may result in legal action against you, and Kallas reserves the right to terminate services to customers found in violation.
5. Enforcement of Policy
5.1 Monitoring and Auditing
Kallas actively monitors compliance with this policy and reserves the right to:
- Audit customer usage of our materials for potential IP violations
- Investigate suspected violations based on complaints, reports, or routine checks
5.2 Consequences of Policy Violation
Kallas may take the following actions if we determine a customer is in breach of this policy:
- Immediate cessation of services or orders
- Suspension or termination of accounts found to be violating this policy
- Legal proceedings to protect Kallas’ rights and intellectual property, including claims for damages or injunctive relief
Kallas will fully cooperate with copyright holders, law enforcement agencies, and other authorities in cases of IP infringement.
6. Reporting Infringements
If you believe that your intellectual property has been infringed upon through the use of Kallas 3D printing materials, you can submit a formal Copyright Infringement Notice.
Your report should include:
- A description of the copyrighted work you believe has been infringed
- Details identifying the infringing material (file names, web links, or other identifying data)
- Your contact details, including name, email address, and phone number
- A statement affirming that you have a good-faith belief that the material is being used without authorization
- A signed declaration stating that the information is accurate and that you are authorized to act on behalf of the copyright holder
All valid reports will be reviewed by Kallas and appropriate action will be taken based on the circumstances.
7. Legal Protection and Indemnity
By using Kallas materials, you agree to defend, indemnify, and hold harmless Kallas, its affiliates, and employees from any claims, damages, and liabilities arising out of:
- Your unauthorized use of intellectual property
- Any claims by third parties alleging infringement caused by your use of Kallas products
- Any legal disputes resulting from the sale, distribution, or printing of copyrighted or trademarked content
Kallas will take appropriate steps to protect its rights and ensure that our customers act in compliance with all IP laws.
8. Amendments to the Policy
Kallas reserves the right to amend or update this Copyright and Usage Policy at any time, with or without prior notice. All changes will be effective immediately upon posting on Kallas’ official website or notification.
Continued use of Kallas materials after policy changes constitutes acceptance of the latest version of this policy.
9. Acknowledgement and Acceptance
By purchasing or using Kallas 3D printing materials and services, you confirm that:
- You have read, understood, and agreed to comply with the terms outlined in this policy
- You are aware of your legal responsibilities regarding the use of designs and intellectual property in your 3D printing projects
