Terms & Conditions for Filaments/Scanners
1. Product Specifications and Suitability
- Kallas try to provide accurate and comprehensive specifications for all Kallas Materials, including, but not limited to, material composition, dimensional tolerances, color consistency, recommended processing parameters (e.g., extrusion temperature), and mechanical properties. This information is accessible to the Customer via product packaging, technical datasheets, and the Kallas corporate website.
- Due to the inherent variability of additive manufacturing processes and the multiplicity of equipment configurations, Kallas does not warrant that the Customer will achieve identical results in every instance.
- The Customer acknowledges and agrees that determining the suitability of Kallas Materials for their specific application, intended use case, and production environment is the sole responsibility of the Customer. Factors such as printer compatibility, software configurations, design complexity, and ambient conditions may significantly influence the final printed product. Kallas recommends that the Customer conduct thorough testing and validation procedures to ensure the attainment of desired outcomes.
2. Material Quality and Consistency
- Kallas is committed to upholding rigorous quality control standards throughout its manufacturing operations. Kallas Materials undergo comprehensive quality assurance protocols to ensure compliance with published specifications. However, minor variations in color, surface texture, or other non-critical attributes may occur between production lots.
- In the event of a material defect directly attributable to Kallas’s manufacturing processes that demonstrably impairs printability or the structural integrity of the printed part, the Customer must provide written notification to Kallas within [Number] days of receipt of the product. Said notification must include detailed documentation and substantiating evidence of the defect.
- Kallas, at its sole discretion, may elect to provide a replacement for the defective material or issue a credit to the Customer. This warranty is strictly limited to the purchase price of the Kallas Materials and does not extend to any consequential damages, indirect losses, or incidental expenses, including, but not limited to, printing costs, labor costs, or loss of production.
3. Safe Handling and Storage
- The Customer bears full responsibility for the safe handling and storage of Kallas Materials. Many 3D printing filaments are hygroscopic and may absorb moisture from the surrounding environment, potentially compromising print quality. Kallas recommends that the Customer store unused filaments in a controlled environment, specifically a cool, dry location, ideally within hermetically sealed containers containing desiccant.
- The Customer shall consult the Safety Data Sheet (SDS) for each Kallas Material, available on the Kallas website, for detailed information pertaining to potential hazards, recommended handling precautions, and proper disposal methodologies. It is the Customer’s responsibility to ensure that all personnel utilizing Kallas Materials are fully apprised of and adhere to these safety guidelines.
4. Intellectual Property
- The purchase and utilization of Kallas Materials does not confer upon the Customer any intellectual property rights in the materials themselves or the proprietary manufacturing processes employed in their production.
- The Customer is solely responsible for ensuring that their use of Kallas Materials in the creation of custom models, prototypes, or end-use parts does not infringe upon the intellectual property rights of any third party. The Customer shall indemnify and hold Kallas harmless from any claims, liabilities, or expenses arising from any such infringement.
5. Limitation of Liability
- To the maximum extent permitted under applicable law, Kallas shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including, without limitation, damages for loss of profits, revenue, data, or business interruption, arising out of or in connection with the purchase, use, or inability to use Kallas Materials, even if Kallas has been advised of the possibility of such damages.
- Kallas’s total and aggregate liability to the Customer for any claim arising out of or relating to these Terms and Conditions or the Kallas Materials shall not exceed the purchase price paid by the Customer for the specific materials that are the subject of the claim.
6. Governing Law and Dispute Resolution
- These Terms and Conditions shall be governed by and construed in accordance with the laws of Jurisdiction Visakhapatnam , Andhra Pradesh.
- Any dispute arising out of or relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts located in Jurisdiction Visakhapatnam, Andhra Pradesh.
