Terms & Conditions for Scanning

These Terms and Conditions are designed to be clear and comprehensive, outlining the agreement between the client and KALLAS for our 3D scanning services. By choosing to work with us, you are agreeing to the terms detailed below. Please read them carefully.

1. Scope of Services

KALLAS specializes in using advanced 3D scanning technology to create accurate digital representations (3D models) of physical objects. Our standard services typically involve:

  • Raw Scanning: The initial process of capturing the physical object’s geometry using our 3D scanner. This results in a raw digital point cloud or mesh data.
  • Mesh Cleanup: Processing the raw scan data to remove noise, fill small gaps, and create a cleaner, more usable 3D mesh.
  • File Formatting: Converting the processed 3D model into a standard digital file format suitable for various applications. Common formats include STL, OBJ, and PLY. We can also discuss other formats if you have specific needs.
  • Optional CAD Conversions: Upon your request and at an additional cost, we can convert the 3D mesh into a CAD (Computer-Aided Design) model. This allows for precise measurements, modifications, and integration into engineering or design software. This often involves creating parametric or solid models. We will clearly outline the specific services included in your project proposal.
2.Customer Obligations

To ensure a smooth and successful scanning process, we require the following from you:

  • Object Condition: You are responsible for providing the object(s) intended for scanning in a condition suitable for the process. This means the object should be:
    • Clean: Free from dust, dirt, grease, or any other contaminants that could interfere with the scanner’s accuracy.
    • Dry: Completely dry to prevent damage to our equipment and ensure accurate data capture.
    • Stable: Able to maintain its shape and form during the scanning process. We may require appropriate support or fixtures for unstable objects, which might involve additional discussion and potentially cost.
  • Legal Rights:

You guarantee that you have the full legal right to reproduce or digitize the item(s) you provide to us. KALLAS will not be held responsible for any copyright or intellectual property infringements related to the objects scanned.

  • Specific Requirements: It is crucial that you communicate any specific requirements you have for the scanning process and the final output before we begin the work. This includes:
    • Desired Resolution: The level of detail you need in the 3D model. Higher resolution scans take longer and result in larger files.
    • Preferred File Format(s): If you have specific software or applications in mind, let us know your preferred file format (e.g., STL for 3D printing, OBJ for visualization).
    • Required Scale or Dimensions: If the digital model needs to be at a specific scale or have accurate dimensions, please provide this information.
    • Specific Areas of Interest: If there are particular features or areas of the object that require extra attention or higher detail, please highlight these.
3. Scanning Limitations

While our 3D scanning technology is advanced, there are certain limitations to be aware of:

  • Surface Properties:
    • Reflective Surfaces: Shiny or mirror-like surfaces can deflect the scanner’s light source, making accurate data capture difficult. We may need to apply a temporary, non-damaging scanning spray to these surfaces to diffuse the light. This will be discussed with you beforehand, and there might be an additional charge for the material and application.
    • Transparent or Translucent Surfaces: Materials like glass or clear plastics allow light to pass through, preventing the scanner from accurately reading their surface geometry. Scanning these types of objects is often challenging or impossible without specialized techniques or pre-treatment.
    • Dark-Colored or Black Surfaces: Dark surfaces absorb light, which can also hinder the scanning process. Similar to reflective surfaces, pre-treatment with scanning spray might be necessary.
  • Geometric Challenges:
    • Deep Cavities and Undercuts: Areas that are deeply recessed or hidden from the scanner’s line of sight may not be fully captured. We will do our best to minimize these blind spots through multiple scan angles, but complete capture cannot always be guaranteed.
    • Hollow Interiors: Our standard scanning process captures the external surfaces of an object. Capturing internal geometry requires specialized techniques or equipment and would need to be discussed as a separate, potentially more complex service.
    • Thin or Flexible Structures: Very thin or flexible objects can be prone to movement or deformation during scanning, which can affect the accuracy of the final model. We will take precautions, but the inherent nature of the object might limit the achievable detail.
  • Feasibility Assessment:

We will assess the feasibility of scanning your object(s) based on their material properties and geometry. While we strive for the best possible results, KALLAS cannot guarantee a 100% complete and accurate capture in all situations. We will communicate any potential challenges or limitations we foresee before commencing the scanning process.

4.Data Handling & File Delivery

We understand the importance of your data and have secure processes in place:

  • Output File Formats: Our standard output file formats are STL, OBJ, and PLY, which are widely compatible with various 3D software and applications. If you require a different file format, please let us know, and we will do our best to accommodate your request.
  • File Delivery: We offer convenient and secure methods for delivering your digital files:
    • Secure Cloud Storage: We can upload your files to a secure cloud storage platform, providing you with a private link to download them.
    • Physical Media: Upon request, we can deliver the files on a USB drive or other physical media. Additional charges may apply for the cost of the media and shipping.
  • Data Retention: We will retain the scanned data on our secure servers for a period of 30 days after the final delivery of the files to you. This allows for a reasonable period for you to review the data and request any minor revisions within the timeframe specified . After 30 days, the data may be securely archived or deleted unless we have a specific agreement for longer retention. If you require us to retain the data for a longer period, please discuss this with us.
5.Intellectual Property & Usage Rights

We respect your intellectual property rights:

  • Client Ownership:

You, the client, retain full ownership of the scanned object(s) and the corresponding digital 3D models we create. We are simply providing a service to digitize your physical items.

  • No Unauthorized Use:

KALLAS will not use, share, or distribute your scanned models or any related information with any third party without your explicit written consent.

  • Non-Disclosure Agreements (NDAs):

If your project involves sensitive or confidential information, we are happy to sign a Non-Disclosure Agreement (NDA) to provide you with an additional layer of protection. Please provide us with your NDA template or let us know you require one before we begin the services.

  • Data Protection:

We are committed to protecting the confidentiality and integrity of your data and will implement appropriate security measures to prevent unauthorized access or disclosure.

6.Confidentiality

Confidentiality is paramount in our operations:

  • Secure Handling:

KALLAS ensures the full confidentiality of all scanned items and any associated data you provide to us.

  • Protection of Sensitive Information:

All proprietary designs, trade secrets, and any other sensitive content contained within the objects you provide will be handled with the strictest privacy measures. Our team is trained on data protection protocols.

7.Revisions & Additional Services

We aim for your complete satisfaction:

  • Included Basic Post-Processing:

Our standard service includes basic post-processing steps such as:

    • Noise Removal: Eliminating unwanted artifacts or irregularities from the raw scan data.
    • Hole Filling: Closing small gaps or holes in the 3D mesh.
    • Watertight Sealing: Ensuring the model is a closed volume, which is often necessary for 3D printing.
  • Additional Services (at Extra cost):

For more complex requirements, we offer advanced editing and other services at an additional cost, including:

    • Advanced Editing: More extensive cleanup, smoothing, and refinement of the 3D mesh.
    • CAD Conversion: Creating precise, parametric CAD models from the scanned data.
    • Dimensional Modifications: Adjusting the scale or specific dimensions of the 3D model.
    • File Optimization: Reducing the file size while maintaining acceptable quality.
    • Texture Mapping: Applying color or texture information to the 3D model (if applicable and requested).
  • Revision Requests:

If you require any revisions to the delivered files, you must notify us in writing within 7 days of the file delivery date. We will assess the requested revisions and determine if they fall under basic post-processing or require additional work, which may incur extra charges. Revisions requested after this 7-day period may be subject to additional fees.

8.Pricing & Payment

Our pricing is transparent and based on the specifics of your project:

  • Pricing Factors:

The cost of our services is determined by several factors, including:

    • Object Size: Larger objects generally require more scanning time and processing.
    • Object Complexity: Objects with intricate details or complex geometries may require more detailed scanning and post-processing.
    • Scanning Time: The total time spent scanning the object(s).
    • Required Output: The desired file format, level of detail, and any additional services requested (e.g., CAD conversion). We will provide you with a detailed quotation based on your specific needs.
  • Deposit Requirement:

To confirm your order and schedule your project, a non-refundable 50% deposit of the total quoted price is required. Work will commence once the deposit is received.

  • Final Payment:

The remaining 50% balance is payable upon the final delivery of the completed 3D model files.

  • Payment Terms:

We accept various payment methods, which will be outlined in our invoice.

  • Non-Refundable Payments:

Please note that all payments are final and non-refundable once the scanning process has begun, as we will have allocated resources and time to your project.

9.Liability & Risk

We take utmost care with your objects, but certain limitations apply:

  • Handling Fragile or Unstable Items:

While we handle all items with care, KALLAS is not responsible for any damage that may occur to objects that are inherently fragile, unstable, or have not been properly packed or prepared for transport and scanning by the client.

  • Disclosure of Delicate Items:

It is your responsibility to clearly disclose to us if an item is particularly delicate, antique, has pre-existing damage, or requires special handling procedures. We will discuss the risks involved and may need to adjust our approach or decline the scanning of such items if the risk of damage is deemed too high.

  • Downstream Use of Scanned Data:

KALLAS is not liable for any consequences arising from your use of the scanned data, including but not limited to:

    • Errors or inaccuracies in reproduction or manufacturing based on the 3D model.
    • Any legal issues related to the reproduction, distribution, or infringement of intellectual property rights if you did not have the legal right to digitize the object in the first place.
10.Delivery Timelines

We strive to deliver your project in a timely manner:

  • Standard Delivery:

Our standard delivery timeframe for completed 3D model files is typically within 3 to 7 business days from the completion of the scanning process. This timeframe may vary depending on the complexity and scope of the project.

  • Communication of Delays:

We will promptly communicate any potential delays that may arise due to factors such as:

    • Client-side changes or requests made after the project has commenced.
    • Unclear or incomplete initial instructions.
    • External factors beyond our control (e.g., equipment malfunction).
11.Cancellation Policy

If you need to cancel your project, please notify us in writing as soon as possible:

  • Cancellation Fees: Depending on the stage of the project at the time of cancellation, a cancellation fee may apply to cover the work already completed and resources allocated. This fee will be determined on a case-by-case basis.
  • Our Right to Decline Service: KALLAS reserves the right to decline to provide scanning services if, upon receiving the object, we deem it unsuitable for scanning due to its condition, material properties, or any other reason that could compromise the quality of the results or damage our equipment. In such cases, any deposit paid may be refunded, less any reasonable costs incurred.
12.Dispute Resolution

We aim for amicable resolutions:

  • Governing Law: Any disputes arising from the services provided by KALLAS shall be governed by the laws of the Republic of India.
  • Negotiation: Both client and KALLAS agree to first attempt to resolve any disputes through good-faith negotiation. We believe that open communication can often lead to a satisfactory resolution for both parties.
  • Legal Remedies: If negotiation fails to resolve the dispute, both parties may then pursue other legal remedies available under the applicable laws.
13.Acceptance of Terms

By engaging KALLAS for our 3D scanning services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. This agreement constitutes the entire understanding between you and KALLAS regarding the provision of 3D scanning services.
